The MLG Foreclosure Defense Program

The hiring of an Attorney is a matter that should be carefully considered. If you have already hired an attorney this section may not be for you. In most cases, a foreclosure lawsuit (being sued by your bank for your house) is practically the only lawsuit that most hope will take as long as possible. Why? Typically no mortgage payment is being made during the suit. Unlike most attorneys, MLG is and has been directly involved in foreclosure defense since long before the current mortgage crisis. Most of the attorneys on staff have been published and recognized by the media for their efforts in defending homeowners rights.

When you defend against a foreclosure, there are typically 3 ways to hire and pay for an attorney.

First is by fee retainer:
Your attorney charges you by the hour for his work. You pay a retainer fee (typically a few thousand dollars) and your attorney draws against it. When your retainer is used up, you get a call for more $$$, your defense continues and you retain the use of the house, etc. etc.

Second is by flat fee:
You are charged a 1-time fee, typically a few thousand dollars. The question that arises with this fee model is after 9-14 months when the motions are flying back and forth and court appearances happen one after the other, there is not much motivation for your attorney to fight to keep the case alive for another 12 months. In fact the sooner the case is over the more per hour the attorney will make.

Third is by monthly fee:
This model you are charged a monthly fee for the defense of the case. Your payment is made with the understanding that by paying monthly, should the time spent on your case exceed the fee for that month you will not be charged anything additional. This has proven to be the best way to extend the foreclosure case to it’s maximum, as your attorney knows that if he can keep you in the house next month he will be paid again.

The MLG Foreclosure Defense Model

At Mitigation Law Group, foreclosure defense uses the monthly fee model. Consequently some clients are still defending their homes 24 months or more after being served. Others who are served during the loan modification process are simply looking for the assurance of legal representation while in negotiations.
